Terms of Service
The basics of using Aevia.

Welcome to Aevia. These Terms of Service ("Terms") are an agreement between you and Canyon Medical Inc. Please read them, because they explain what Aevia is, how subscriptions and cancellations work, and the limits of what the product can do.
1. Who we are and what these Terms cover
Aevia is operated by Canyon Medical Inc. ("Canyon Medical", "we", "us", or "our"). These Terms cover your use of our website, your purchase and use of the Aevia patch, and any related apps and services (together, the "Services"). By using the Services, reserving, or buying Aevia, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
2. Who can use Aevia
You must be at least 18 years old and able to enter into a contract to buy or use Aevia. You are responsible for keeping your account details accurate and your login secure, and for activity that happens under your account.
3. Aevia is a wellness product, not medical care
This is the most important section, so we have kept it plain. Aevia is a general wellness product. It helps you follow trends in your body's signals and notice change over time. Aevia is not a medical device. It does not diagnose, treat, cure, or prevent any disease, and it is not a substitute for professional medical advice, diagnosis, or care. Always talk with a qualified healthcare provider about your health and before acting on anything you see in the product.
Aevia is not an emergency service. Its alerts, including any fall or motion signal, are a helpful prompt and not a guarantee, and they do not contact emergency services for you. If you think you are having a medical emergency, call 911 or your local emergency number right away.
4. Orders, subscriptions, and billing
Aevia is offered as a membership. When you start a plan, you authorize us to charge your payment method the plan price, plus any applicable taxes, on a recurring basis until you cancel. Plan prices, billing periods, and what is included are shown at checkout. Founding or promotional prices apply as described at the time you join.
Automatic renewal. Your membership renews automatically at the end of each billing period at the then-current price, unless you cancel before the renewal date. We will give notice of renewals and any price changes where the law requires it.
Cancellation. You can cancel at any time from your account or by contacting us, and cancelling is as easy as signing up. When you cancel, your membership stays active until the end of the period you have already paid for, and it will not renew after that. Except where required by law or stated in our refund terms, payments already made are not refundable for partial periods.
Trials and guarantees. If we offer a trial or a risk-free period, its length and terms are described when you sign up. Unless we say otherwise, a trial converts to a paid membership at the end of the trial period if you do not cancel first.
5. Shipping, resupply, and returns
We ship patches and resupply on the schedule described in your plan. Risk of loss passes to you on delivery. If a product arrives damaged or faulty, contact us and we will make it right. Our returns and refund terms, including any satisfaction guarantee, are described at checkout and in your account, and they apply in addition to any rights you have under law.
6. Using the Services responsibly
You agree to use the Services only for lawful, personal, non-commercial purposes, and not to: misuse, copy, reverse engineer, or tamper with the patch, software, or website; interfere with the security or operation of the Services; resell the product or access without our permission; or use the Services in any way that breaks the law or these Terms.
7. Our content and your content
The Aevia name, logo, website, software, designs, and content are owned by Canyon Medical or our licensors and are protected by intellectual property laws. We give you a limited, personal, non-transferable right to use the Services as intended. You keep ownership of content you submit, such as a review or a message, and you give us permission to use it to operate and promote the Services. If you post a review, it must be honest and your own experience.
8. Third-party services
The Services may link to or rely on third parties, such as payment, shipping, or app-store providers. We are not responsible for their content or practices, and your use of them is subject to their own terms.
9. Disclaimers
We work hard to make Aevia dependable, but the Services are provided "as is" and "as available". To the fullest extent allowed by law, we disclaim all warranties not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error free, or perfectly accurate, or that readings will catch every change in your health. Nothing in these Terms limits any rights you have under consumer-protection law that cannot be waived.
10. Limitation of liability
To the fullest extent allowed by law, Canyon Medical and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Services. Where liability cannot be excluded, our total liability for any claim relating to the Services is limited to the amount you paid us for the Services in the twelve months before the claim. Some states do not allow certain limits, so parts of this section may not apply to you.
11. Indemnification
You agree to cover reasonable losses we incur if they arise from your misuse of the Services or your breach of these Terms, to the extent allowed by law.
12. Governing law and disputes
These Terms are governed by the laws of the State of Delaware and applicable United States federal law, without regard to conflict-of-law rules. Before starting any formal dispute, please contact us so we can try to resolve it together; most concerns are settled quickly that way. If we cannot resolve a dispute informally, it will be handled by the courts or dispute-resolution process described to you at the time, and nothing here removes any right you cannot waive under the law of the state where you live.
13. Changes to these Terms
We may update these Terms from time to time. When we make a material change, we will update the date above and, where appropriate, notify you. Your continued use of the Services after an update means you accept the revised Terms.
